TERMS OF SERVICE

By commissioning me, you agree that you have read and accepted all the terms described herein.

GENERAL
- Prices listed are starting prices that may be raised based on artwork complexity at my discretion.
-Commissions are for Personal Use only unless Commercial rights are purchased.
-I reserve the right to decline commissions that I believe are outside my abilities or that I do not feel comfortable drawing for any reason.
-All sales are of Digital Artwork only, No physical product will be delivered.
-Communication will be done via email.
-By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms and conditions.PAYMENT
- All payments are done in United States Dollar (USD).
- Payment is to be paid in full upfront through Paypal, unless a Payment Plan has been previously agreed upon (only for full illustration commissions), before any work on commission begins.
- Requests will be cancelled if the invoice is not fully paid within 1 week.REFUNDS
- All commissions are non-refundable and can only be cancelled before any payment is made.
- I have the right to cancel and refund a commission request at any time if faced with harassment, indecisiveness, health issues, poor communications, or any similar reason.TIMELINE AND DELIVERY
- Once commission details and costs are discussed and agreed upon with the client, a Paypal invoice will be sent. Once the invoice is paid in full, work will begin on sketching and any preliminary colour tests which will be sent to the client for approval before painting begins. Once a commission is finished, the client will receive a JPG and PNG of ordered artwork.
- Average turnaround: 1 week - 4 months depending on complexity.
- Rush commissions with a set deadline will incur an extra fee amount of which will be at my discretion.
- Client will be notified of any complications that may affect delivery time.
- Client may ask for updates at any time, however asking too frequently may be considered harassment and result in the cancellation of the commission.REVISIONS
- Very minor changes or key details missed by the artist that are clearly seen in given references can be fixed with no extra fee.
- 2 revisions are permitted with no fee at the sketch stage, all further edits or revisions that stray too far away from original agreed upon composition will incur a fee amount of which will be at my discretion.
- Major revisions (e.g. pose change, colour change, or any other significant changes) and revisions requested after the sketch has been approved will not be accepted.INTELLECTUAL PROPERTY RIGHTS
- I, the artist, retain all rights to the commissioned artwork. Client is purchasing usage rights and not ownership of the artwork itself.
- By commissioning me, you are purchasing my service as an artist only.I reserve the right to use the artwork to:
- Promote myself and my services.
- Post on social media and use in my portfolio.
- Create prints/merchandise (for fanart commissions only).COMMISSIONER RIGHTS
You may:
- Use the artwork for Personal purposes only (including but not limited to: profile pictures, banners, phone or computer wallpapers, printing for yourself or as a gift) unless Commercial Rights are purchased.
- Post work on Social Media with visible credit to me (Twitter/Bluesky: @odeeria, Instagram: @odeeriaa).You may NOT:
- Use the artwork commercially without permission (e.g. selling merch, streaming, business branding or any other use for profit).
- Claim the artwork as your own or fail to credit me.
- Remove signatures/watermarks.
- Modify the artwork without my consent.NFT & AI POLICY
- Clients are not permitted to use commissioned artwork for any NFT or AI projects.COMMERCIAL USAGE AGREEMENT
- If you wish to order a commission for Commercial use, the total price of the commission, as well as any other royalties, will be agreed upon upfront.
- The minimum commercial use fee is 100% of the original price. However, I reserve the right to charge more if I deem fit.WON’T DRAW
